RIVS Terms and Conditions
Welcome to Real Intelligence Valuation Services (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our Services, as further defined below. By accessing or using our website and Services, you agree to be bound by these Terms, which together with our Privacy Policy represent the legally binding agreement between you (“you,” “your,” “user,” or “client”) and us.
Before you use, access, or purchase any Services on this website or any related platforms (collectively called the “Site”), please take a moment to read these terms. They explain important aspects of our Services and include details about how legal issues are handled. Specifically, these terms include agreements about resolving disputes through arbitration instead of going to court, and they involve waiving the right to participate in class action lawsuits. Arbitration is a required process for resolving any disagreements, as outlined in the dispute resolution section below, so please review that carefully.
IF YOU DO NOT WISH TO ACCEPT THESE TERMS, PLEASE DO NOT USE, PROVIDE ANY INFORMATION TO, OR PURCHASE ANY SERVICES ON, THE SITE.
Property Valuation Service
We provide property valuation services to help inform you about the possible value of your property in a comparable market. In that respect, “Services” encompasses both the process of generating a valuation and the time spent developing the resulting report that is provided to you.
When providing Services, we use a combination of aggregated public records, licensed data, analytical tools, publicly available data, third-party sources, and proprietary algorithms. This includes data from sources like MLS, city records, and public records. Importantly, we do not utilize artificial intelligence (“AI”) to generate your report, which is a distinguishing factor we take pride in offering our clients.
These valuations are general opinions of potential real property value based on modeling assumptions and available data. As a result of these Services, a report will be generated and provided to you in a digital format sent via e-mail. Please note that it is your obligation to ensure that you provide us with the correct e-mail address. Failure to receive the report if sent to the e-mail address provided to us is not grounds for any refund or the generation of a new report.
The Valuation Report
The report reflects the valuation—generated through a proprietary process that may include:
- Public property records and tax assessment data;
- Historical and comparable sales data;
- Local market trends and geospatial data; and/or
- Statistical modeling, machine learning, and other analytical methods.
We reserve the right to change or discontinue our methodologies at any time without notice. We make no commitment to update any data or information provided through the Services.
Our report reflects market conditions and data available at the time of its generation. Due to the dynamic nature of real estate markets, the information provided in the report is intended for informational purposes at the time it was created and should be considered valid for a period of thirty (30) days from the date of issuance.
Billing and Payment Policy
Before submitting an order for Services (the “order”) and completing any purchase on the Site, you will be shown the applicable fees, which are non-negotiable and set as listed or otherwise conveyed by us to you, at the point of payment. Full payment is due upon purchasing Services, and all payments are non-refundable (except as set forth herein), regardless of the resulting information provided in the report. Sales and use taxes may apply based on your location. You are responsible for all applicable taxes unless we are required to collect and remit them on your behalf.
By placing an order, you authorize us to charge your chosen payment method. We may request additional information to verify your payment method. If verification fails, we reserve the right to decline the order. We do not accept payment by check, cash, or money order.
Payments are processed by a third-party provider, and your use of its services is subject to its respective terms and conditions, which you acknowledge and to which you agree by submitting your payment information. In doing so, you also confirm that you are at least 18 years old and have the legal right to use the selected payment method. Furthermore, you understand and agree that we are not responsible for the services, actions, or security practices of this third-party provider, including the security of your payment data while it is in its possession.
If you believe your payment method was used fraudulently in connection with a purchase, please contact customer service immediately at office@rivaluations.com.

Changes to Pricing and Billing Practices
We reserve the right to modify our pricing or billing terms, and providing notice of such changes on the Site will be considered sufficient notification. No changes will apply retroactively. If you do not agree to the changes, you may discontinue your use of the Services and the Site. Continued use of the Site for more than seven (7) days after notice will be deemed acceptance of the new terms.

Cancellation Policy
If you cancel your specific property evaluation request within twelve (12) hours of purchase and we approve a transfer of your payment, you must use the transferred funds for another property evaluation within thirty (30) days of your original purchase date. If the transferred funds are not used within this thirty-day timeframe, the fees you initially paid will be forfeited. A request for transfer of your payment to a new evaluation must be submitted in writing and may only be approved once. Payment must be made via your verified payment method. Please note that no report will be provided to you until payment in full is received and processed by us.
Billing Errors, Promotional Prices, and Discounts
Any promotional pricing or discounts will be clearly displayed at checkout. If you believe there is an error in your billing, please contact Customer Support as soon as possible at office@rivaluations.com. We are committed to resolving billing issues promptly and efficiently.
Treatment of Reversals and Chargebacks
As with other online services, intentional credit or debit card chargebacks may indicate fraudulent use or unauthorized access to our Services. We reserve the right, in our sole discretion, to investigate any such activity and to report suspected fraud or theft to the appropriate local, state, or federal authorities.
User Obligations
You agree to provide us with accurate, current, and complete information, including your e-mail address, that you are legally authorized to share with us.
You must be at least 18 years old and capable of entering into a legally binding agreement to purchase the Services. You may only use the Services for lawful purposes and in accordance with these Terms. Prohibited uses include, without limitation:
- Using Services for employment, tenant screening, credit, insurance, or other consumer-related eligibility decisions;
- Reproducing, modifying, distributing, or reverse-engineering any portion of the Services;
- Using the Services for any unlawful, defamatory, harassing, or fraudulent purposes; and/or
- Scraping or harvesting data from the Services without our express written consent.
We provide access to the Site as available and subject to these Terms. You are solely responsible for your use of the Site and any information you obtain through it. We reserve the right, at our sole discretion, to:
- Monitor, audit, or review use of the Site, including any information accessed or actions taken by visitors;
- Investigate potential misuse or suspicious activity, including verifying the identity and intent of any user;
- Refuse, cancel, or limit access to any orders we suspect are connected to fraud, prior chargebacks, or violations of these Terms;
- Restrict or deactivate access if we determine, in our judgment, that the Site is being used for unauthorized or impermissible purposes.
General Disclaimers
These Services are for general informational purposes only.
Any information provided to you should not be used as a substitute for an appraisal.
We are not providing these Services as your agent, broker, appraiser (whether as trainee, licensed residential appraiser, certified residential appraiser, or certified general appraiser), or fiduciary. The valuations do not and shall not constitute or be construed as appraisals prepared by licensed or certified appraisers under any federal, state, or industry standards, including the Uniform Standards of Professional Appraisal Practice (USPAP). You acknowledge that we are not a party to any transaction in which you may engage related to the use of the Services.
You understand and acknowledge that this valuation is not a substitute for an appraisal. We strongly recommend that you engage licensed appraisal professionals if you require a certified appraisal. Use of the Services is at your sole risk and discretion.
All property value estimates, valuations, analytics, content, and data provided through the Services are offered for general educational and informational purposes only and are provided “AS IS” and “AS AVAILABLE” without warranty of any kind.
Disclaimer of Warranties
This Site, including all content, services, data, and tools made available through it—such as property value estimates and related reports—is provided on an “as is” and “as available” basis. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, DATA ACCURACY, SECURITY, AVAILABILITY, AND QUIET ENJOYMENT.
We want to be clear that we provide our services without any guarantees regarding their accuracy, reliability, completeness, error-free operation, or continuous availability. Furthermore, we do not represent or warrant that the services will meet your specific requirements. Similarly, we offer no assurances that the Site or any of its content will align with your expectations or intended use, will operate without interruption, delay, security breaches, or errors, will be free of viruses or harmful elements, will ensure uninterrupted access or protection from interference or third-party claims, or will be consistently current, complete, or accurate.
You understand that some content may be outdated, incomplete, or based on public records that have since changed or are no longer available. We make commercially reasonable efforts to provide accurate and useful information but rely on third-party sources. You acknowledge that you are solely responsible for verifying any information before relying on it for financial, legal, or other decisions. The views expressed in any articles, blog posts, or user content are those of the authors and do not necessarily reflect our views or policies.
Your use of the Site is at your sole risk. We are not responsible for the availability or reliability of your internet connection or the accuracy of any third-party content. No oral or written information provided through the Site or by our team will create any warranty not expressly stated in these Terms.
Proprietary Rights
All content and materials available on the Site—including design, data, text, graphics, tools, reports, and any related services—are the property of RIVS LLC d/b/a Real Intelligence Valuation Service or its licensors and are protected by intellectual property laws. Except as expressly permitted in these Terms, you are not granted any rights in or to our trademarks, copyrights, patents, trade secrets, or other proprietary materials. Use of the Site does not grant you ownership of any part of the Site, its services, or the content accessible through it. All rights not expressly granted are reserved.
Feedback and Submissions
We welcome suggestions for improving the Site and our Services. By submitting feedback, you represent that you have the right to share it and that it does not infringe any third-party rights. You grant us a perpetual, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, distribute, display, and create derivative works from your submissions, in any form or media, for any purpose, without notice or compensation to you. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, LICENSORS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, OR OTHER DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES OR ANY INFORMATION PROVIDED THROUGH THE SERVICES OR THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS, IN THE AGGREGATE, EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US, IF ANY, FOR ACCESS TO THE SERVICES IN THE SIX (6) MONTHS IMMEDIATELY PRIOR TO THE EVENT GIVING RISE TO SUCH CLAIM.
THE LIMITATIONS IN THIS SECTION SHALL APPLY TO ALL CLAIMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
Indemnification
You agree to indemnify, defend, and hold harmless RIVS LLC d/b/a Real Intelligence Valuation Services, its affiliates, licensors, and their respective officers, directors, employees, and agents from and against all claims, demands, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, directly or indirectly arising from or in any way connected with:
- Your use of or reliance on the Services;
- Your breach or violation of these Terms;
- Your violation of any applicable laws or the rights of any third party; and/or
- Any data or content submitted by you to the Services
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.
You are obligated to indemnify, defend, and hold RIVS LLC d/b/a Real Intelligence Valuation Services, its affiliates, agents, employees, and licensors completely harmless from any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses, including all reasonable attorneys’ fees, directly or indirectly arising from or in any way connected with your use of the Site, any breach of this Agreement, your violation of any applicable law or regulation, or your infringement upon any proprietary or privacy right. This obligation to indemnify and defend is a strict and material condition of your use of the Site.
You agree to defend, indemnify and hold RIVS LLC d/b/a Real Intelligence Valuation Services, its parents, subsidiaries, affiliates, joint ventures, and third-party service providers, and each of their respective members, officers, directors, employees, agents, shareholders, co-branders, content licensors, suppliers, contractors, attorneys, and other partners, harmless from and against any and all liabilities, claims, expenses (including reasonable attorneys’ fees), damages, suits, costs, demands, and judgments made by any third party, including, but not limited to, by any Search Subject, arising from or related to: (a) your use of the Site or any Content you obtain through the Site (b) your failure to comply with these Terms including, but not limited to, your violation of any laws or any rights of another individual or entity; or (c) any claim that RIVS LLC d/b/a Real Intelligence Valuation Services is obligated to pay any taxes in connection with your use of the Site, Our Services or otherwise. The provisions of this paragraph are for the benefit of RIVS LLC d/b/a Real Intelligence Valuation Services, its parents, subsidiaries, affiliates, joint ventures, and third-party service providers and each of their respective officers, directors, members, employees, agents, shareholders, co-branders, licensors, suppliers, contractors, attorneys and other partners. Each of these individuals and entities shall have the right to assert and enforce these provisions directly against you on his, her, or its own behalf.
Equitable Relief
You agree that any breach or threatened breach of these Terms or any unauthorized or unlawful use of the Site would result in irreparable injury to RIVS LLC d/b/a Real Intelligence Valuation Services for which monetary damages would be inadequate. In such event, RIVS LLC d/b/a Real Intelligence Valuation Services shall have the right, in addition to other remedies available to it at law and in equity, to immediate injunctive relief without the need to post a bond. Nothing contained in these Terms shall be construed to limit any legal or equitable remedies available to RIVS LLC d/b/a Real Intelligence Valuation Services.
Governing Law, Jurisdiction & Dispute Resolution
THESE TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MINNESOTA, WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAWS PRINCIPLES. ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS SHALL BE RESOLVED EXCLUSIVELY IN HENNEPIN COUNTY, MINNESOTA.
MANDATORY ARBITRATION: ANY AND ALL DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE SUBMITTED TO AND RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY JAMS, IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES THEN IN EFFECT. ARBITRATION SHALL TAKE PLACE IN HENNEPIN COUNTY, MINNESOTA, AND SHALL BE CONDUCTED IN ENGLISH. JUDGMENT ON THE ARBITRATOR’S AWARD MAY BE ENTERED IN ANY COURT OF COMPETENT JURISDICTION.
WAIVER OF CLASS ACTIONS AND JURY TRIAL: YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, REPRESENTATIVE ACTION, OR JURY TRIAL. ALL CLAIMS SHALL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY.
OPT-OUT: YOU MAY OPT OUT OF THIS ARBITRATION PROVISION BY PROVIDING WRITTEN NOTICE TO US AT RIVS LLC d/b/a Real Intelligence Valuation Services WITHIN THIRTY (30) DAYS OF FIRST ACCEPTING THESE TERMS. YOUR OPT-OUT NOTICE MUST INCLUDE YOUR FULL LEGAL NAME AND EMAIL ADDRESS.
Force Majeure
Except for payment obligations, neither party will be liable or considered in breach of these Terms for any delay or failure to perform due to events beyond its reasonable control, including but not limited to acts of God (such as severe weather, natural disasters, or fire), power or network outages, cyberattacks, acts of terrorism, war, civil unrest, government emergencies effecting the Services, governing imposed regulations effecting the Services, labor disputes, or other similar events (each, a “Force Majeure Event”), provided the affected party is unable to prevent or overcome the event through commercially reasonable efforts. The impacted party must promptly notify the other and take reasonable steps to minimize any resulting delay or disruption.
Modifications to Terms
We reserve the right to modify, update, or replace these Terms at any time, at our sole discretion. Any such changes shall become effective immediately upon posting. Continued use of the Services following any changes constitutes your acceptance of the modified Terms.
Severability
If any provision of these Terms is held invalid or unenforceable by any applicable court decision, that provision shall be changed and interpreted so as to best accomplish the objectives of the invalid or unenforceable provision within the limits of applicable law or the applicable court decision, and the remaining provisions of these Terms shall remain in full force and effect.
Waiver
Our decision not to enforce any provision of these Terms, or to delay enforcement, does not waive our right to enforce that provision or any other provision at a later time. Any waiver must be in a signed writing by an authorized officer of RIVS LLC d/b/a Real Intelligence Valuation Service.
Transferability
These Terms will be binding on, inure to the benefit of, and be enforceable by RIVS LLC d/b/a Real Intelligence Valuation Services’ successors and assigns. You are not permitted to transfer, assign, novate, or delegate any rights or obligations pursuant to these Terms unless contained in a signed writing by a duly appointed officer of RIVS LLC d/b/a Real Intelligence Valuation Services, and RIVS LLC d/b/a Real Intelligence Valuation Services reserves the right to immediately terminate your use of the Site and our Services if you attempt to do so.
Your Relationship with RIVS LLC d/b/a Real Intelligence Valuation Services
Nothing in these Terms creates any partnership, joint venture, agency, fiduciary, franchise, sales representative, agent, real estate brokerage, appraisal (whether as trainee, licensed residential appraiser, certified residential appraiser, or certified general appraiser), or employment relationship between RIVS LLC d/b/a Real Intelligence Valuation Services and you or any other party. You expressly acknowledge and represent that you will not, at any time, rely on any individual related to RIVS LLC d/b/a Real Intelligence Valuation Services or the company itself, as having any one of the above relationships with you. You are not authorized to act on behalf of, or make or accept offers, representations, or commitments for, RIVS LLC d/b/a Real Intelligence Valuation Services in any capacity, including as a realtor, appraiser, agent, or fiduciary.
Notice
We may provide legal or other notices to you at our discretion by: (a) posting such notices or links to them on the Site, or (b) sending them via email, postal mail, overnight courier, or facsimile to any contact information you have provided. To provide notice to us, you must send it by U.S. certified mail or by international or domestic overnight courier, postage prepaid, to: Insert Company Legal Mailing Address Notices sent by email or facsimile will not be considered valid unless receipt is acknowledged in a signed writing by an authorized officer.
Entire Agreement
These Terms, the Privacy Policy, and all other applicable operating rules, policies, price schedules, and other supplemental terms and conditions or documents that may be published by us or agreed upon by you from time to time, which are expressly incorporated herein by reference, shall constitute the entire and only agreement between you and RIVS LLC d/b/a Real Intelligence Valuation Services with respect to your use of the Site. These Terms supersede all prior or contemporaneous agreements, representations, warranties and understandings with respect to your use of the Site and the content contained therein.
To the extent that any information or material that appears on or is posted to the Site, or otherwise is made available by us, contains any representation, term, or condition that is in conflict or inconsistent with these Terms, these Terms shall take precedence unless revised terms or conditions are contained in a signed writing by one of our duly appointed officers.
